Terms of Service
Thank you for your interest in our services and taking the time to read our Terms and Conditions of Service. All services, products, and events are offered and operated by Overpsyched LLC (collectively, “Overpsyched”). Your access to Overpsyched.com and all subdomains (the “Site(s)”) and your purchase, enrollment in and use of products, services, tutoring, coaching, and events (collectively, “Services”) offered by Overpsyched are subject to these terms and conditions (collectively, “Terms”). If you access Overpsyched and/or purchase Services for use by another (for example, a guardian purchasing for a child) these Terms govern you and all other(s) who access Overpsyched or use its Services. By accessing Overpsyched, you are agreeing to be bound by these Terms of Service, which is an agreement between Overpsyched and you, and agree that you are responsible for compliance with any and all applicable laws and regulations. If you do not agree with any of these Terms of Services, you are prohibited from using or accessing this Site. Overpsyched may revise these Terms of Service at any time and without notice. By using this Site and/or Services, you are agreeing to be bound by the then current version of these Terms of Service.
All material and services on this web site are protected by applicable copyright and trademark law.
Children: In compliance with the Children’s Online Privacy Protection Act, Overpsyched LLC does not permit children under the age of 13 to purchase or enroll in Services or become users without their parent or guardian’s express consent and approval. Children may provide information to Overpsyched and participate in Services only with consent of a parent or guardian.
Account Security: When registering for a Overpsyched account, you must select a password. You are solely responsible for maintaining the confidentiality of your password, for any and all use of your account, and for restricting access to your account from anyone other than yourself. Overpsyched has the right to refuse Services or terminate your account for any reason in its sole discretion without notice to you.
Communication: When accessing the Sites or Services, you agree to receive communications from Overpsyched electronically, including emails and notices posted to the Site. If you provide Overpsyched with a telephone number, you agree that Overpsyched may contact you about the Services and other opportunities via telephone and/or text message. Standard messaging, data, and other fees may be charged by your carrier.
Payment and Fees: You agree to make full payment for Services in the amount(s) listed in your shopping cart, presented at account registration, emailed as an Order Confirmation, or communicated by representatives. Standard shipping and handling charges apply. You will be entitled to receive the Service only during the subscription period specified by your registration and payment confirmation. You agree to pay Overpsyched the fee specified at the registration form. Fees are paid in advance for the subscription period and a valid credit card is required. Fees are non-refundable and non-transferable, unless otherwise stated in written communication from a Overpsyched representative. Purchases may be subject to taxes. You are responsible for paying all such taxes.
Cancellations, Refunds, and Guarantees: By registering, you understand and agree that you are registering for the Overpsyched Services “as is.” Overpsyched does not warrant or make any representations concerning the accuracy of the content or the completeness of the Services. Overpsyched, its representatives, and its affiliates make no warranty that the Services will meet your needs or expectations, will be uninterrupted, will be secure or error-free, or that any errors will be corrected or updated. There are no refunds or money back guarantees once you have registered and paid for an account. Overpsyched does not promise or guarantee any outcome or score and is solely an opportunity to achieve your desired outcome(s). Overpsyched does not promise or guarantee your acceptance to any school, score or passage of any exam, or any other outcome. Under no circumstances will Overpsyched be responsible for any loss or damage, including any personal injury or death, resulting from anyone’s use of the Site or the Service or third-party applications posted on or through the Site.
Maintenance: Services may be temporarily unavailable for maintenance or other reasons. Overpsyched is not responsible for any error, delay in operation, or interruption of your use of Services.
Intellectual Property: All Services and Sites are owned and operated by Overpsyched LLC. Services are intended for your personal and non-commercial use only. You agree not to reproduce, duplicate, copy, sell, trade, resell, modify, or exploit for any commercial purposes, any portion of the Services or access to the Services. You may not download, screenshot, or record any content. You may not attempt to decompile, reverse engineer, scrape or datamine the Sites and/or Services. You may not enroll in or utilize any Services for the benefit of any competitor of Overpsyched. The logos, designs, trademarks, service marks displayed on the Sites and Services are the registered and unregistered trademarks of Overpsyched LLC or its owner and may not be imitated or used, in whole or in part, without written permission from Overpsyched LLC. Any third party products, including the names of standardized tests, are owned by such third parties and their respective licensors.
User Content: You represent, warrant and agree that no materials of any kind uploaded, submitted, posted, transmitted, or shared by you and/or your account will violate or infringe upon the rights of Overpsyched or any third party, including but not limited to copyright, trademark, privacy, or proprietary rights. Furthermore, you agree any posts, photos, profiles, messages, or text (collectively, “Post”) shared by you and/or your account will not contain any libelous, defamatory, or unlawful content. You are solely responsible for the Posts on or through the Service or Site and any interactions from your account with other users. You may not submit, post, transmit, or share any content that you do not have ownership of or permission to post. You understand and agree that Overpsyched may, but is not obligated to, delete or remove without notice any Post or content in its sole discretion. Furthermore, you acknowledge that Overpsyched may retain archived copies of any material connected to your account, whether you remove or delete the content from the Site or Services yourself.
Conduct: You agree to not upload, submit, post, transmit, or share any Posts that contain libelous, defamatory, or unlawful material. Furthermore, you agree to not submit, post, transmit, or share any Posts that would deem harmful, abusive, threatening, harassing, infringing, inflammatory, hateful, racially or ethically objectionable, vulgar, or invasive of privacy or publicity rights. You will not use the Site or Services to collect any personal information or contact information of other users. You will not upload, post, transmit, or share any unauthorized material for the advertising, solicitation, or promotion of other parties. You agree to not upload, submit, post, transmit, or share any private information of you or any other individual or party, including but not limited to addresses, phone numbers, email addresses, birthdates, Social Security numbers, or credit card information. You agree to not upload, submit, post, transmit, or share any material that may contain software viruses or other computer code.
Consent: Services may occur at facilities, such as hotels and schools, which are not owned, controlled, or operated by Overpsyched. You waive any claim against Overpsyched arising from you or your child’s use of such facilities, including claims related to personal injury or death, safety, or security of the facilities.
Limitation of Liability: The Sites and all Services are provided “as is” and in no event shall Overpsyched LLC be liable for any damages from the use or inability to use the Services or Sites, even if Overpsyched has been informed of the possibility of such damages. In no event will Overpsyched’s total liability to you exceed the amounts paid by you for the Services.
Advertisements: Some of the products advertised on the Sites are sold by third parties. Overpsyched is not liable or responsible for any products and services that may appear on the Sites. You may be able to link from the Site to third party websites. You understand and agree that Overpsyched has no responsibility for any content, products, services, or other materials provided by third party websites. Please click on all links to other websites at your own risk.
Links: Overpsyched LLC has not reviewed all of the sites linked to Overpsyched or its Services and is not responsible for the contents of any such linked sites. Furthermore, inclusion of a link to Overpsyched or its Services does not imply endorsement of or association with the site in any form.
Tutoring Policies: If you purchase a tutoring session, you and your tutor(s) will agree on a time that is mutually convenient to meet. If you have to cancel or postpone a session, you must notify Overpsyched via email (tutor@Overpsyched.com) at least 24 hours in advance. Failure to do so will result in a cancelation or rescheduling fee of $50. If there is an issue with the tutoring session that warrants a refund (for example the tutor does not attend the session), all requests must be sent by email (tutor@Overpsyched.com) within 24 hours after the start of the tutor session. All requests for a refund submitted after 24 hours will not be eligible for a refund. All provisions and policies of these Terms of Service apply to tutoring sessions.
Coaching Policies: If you purchase a coaching session, you and your coach(es) will agree on a time that is mutually convenient to meet. If you have to cancel or postpone a session, you must notify Overpsyched via email (coaching@Overpsyched.com) at least 24 hours in advance. Failure to do so will result in a cancelation or rescheduling fee of $50. If there is an issue with the coaching session that warrants a refund (for example the coach does not attend the session), all requests must be sent by email (coaching@Overpsyched.com) within 24 hours after the start of the coaching session. All requests for a refund submitted after 24 hours will not be eligible for a refund. All provisions and policies of these Terms of Service apply to coaching sessions.
Standardized Tests: Test names and other trademarks are the property of the respective trademark holders, none of whom are affiliated with Overpsyched or this website. GRE® is a registered trademark of the Educational Testing Service (ETS). ETS does not sponsor, endorse, or approve of Overpsyched or this website. GMAT® is a registered trademark of the Graduate Management Admission Council (GMAC). GMAC does not sponsor, endorse, or approve of Overpsyched or this website. MCAT® is a registered trademark of the Association of American Medical Colleges (AAMC). AAMC does not sponsor, endorse, or approve of Overpsyched or this website. DAT® is a registered trademark of the American Dental Association (ADA). ADA does not sponsor, endorse, or approve of Overpsyched or this website.
Miscellaneous: Under the circumstance that Overpsyched fails to exercise and/or enforce any provision of the Terms of Service, such failure shall not constitute a waiver of such right or provision. If any provision(s) of the Terms of Service are held to be invalid or unenforceable, the remainder of the Terms of Service shall not be affected and will continue in full force and effect. These Terms of Service supersede all prior oral or written agreements and constitutes the entire agreement between all parties.
Privacy Policy: As part of the Terms of Service, you understand and consent to the collection, storage, and processing of your personal information by Overpsyched as described by the Overpsyched Privacy Policy, which is available at www.Overpsyched.com/privacy-policy. This Terms of Service and this Privacy Policy apply to www.Overpsyched.com and all subdomains.
